No employer wants its employees to use social media to make public, disparaging remarks. But social media usage can be a form of activity protected by the Pennsylvania Employee Relations Act or the First Amendment. But that is not where the risk ends! Employee or staff usage of social media can also support claims of discrimination, harassment, and defamation. There is also the ever-present concern of a legal liability for the posts of elected officials, which raise a whole host of additional questions (as compared to employees). In this session, we will learn how the line is drawn between free speech and lawful grounds for discipline. We will also learn how municipalities can reduce the risk of liability for employee posts and best practices for elected officials’ social media use.
