This session will cover the ever-evolving law surrounding Pennsylvania's Environmental Rights Amendment. Jon Anderson of the law firm of McNees Wallace will address the impetus for the Amendment's adoption, its historical application, and the continued uncertainty regarding its present application. The focus of the webinar will be on forecasting how recent interpretations and application of the Amendment may impact municipal officials, property owners, developers and regulators. Municipal officials will better understand whether they should expect to have obligations under the Amendment, and the extent of any obligations related to municipally-owned property and land use approvals for privately-owned property.
